Appeals Court Affirms Dismissal of Stryker Knee Implant Case
On April 20, 2016—exactly one year after Shook, Hardy & Bacon secured a judgment in favor of client Stryker Corp. in a knee prosthesis product liability case—the 11th Circuit Court of Appeals affirmed the judgment for Stryker. Sandra Witt claimed that her recalled Stryker knee implant was defective, caused her pain, had to be removed and required her to undergo several additional surgical procedures. In affirming the dismissal of Witt’s claims for Stryker, the appeals court upheld the ruling excluding the unreliable opinion of Witt’s expert witness who claimed the knee implant was allegedly defective and caused Witt’s problems.
