Martucci, Booth and Harrison: California Employment Litigation Trends and Developments
Shook National Employment Litigation and Policy Practice Chair Bill Martucci and Partners Laura Booth and Ashley Harrison have co-authored a Trends and Developments article for the USA – California Section of Chambers and Partners’ Employment 2024 practice guide.
Martucci, Booth and Harrison note that plaintiff win rates in California have increased, as have the percentage of large trial awards. They said the plaintiffs’ bar also continues to use class action litigation to reap large damages awards from employers, including in wage and hour litigation. Martucci, Booth and Harrison said the trends point to California’s role as a trendsetter nationally in employment law.
“Addressing these matters requires a thoughtful, strategic approach,” they said. “The most effective strategy blends an understanding of the law and the litigation dynamics with the human dimension of respect, fulfilment, and promise. California’s public policy protections present remarkably far-reaching implications and nuances for even the most sophisticated employers.”
