Podcast: Civil Justice Reforms With Mark Behrens
Shook Public Policy Practice Group Co-Chair Mark Behrens appeared on the International Association of Defense Counsel’s (IADC) podcast, IADC Speaks, to discuss the latest Lawyers for Civil Justice (LCJ) meeting and reforms to Rule 702 of the Federal Rules of Evidence.
In the episode, titled “Civil Justice Grab Bag,” Behrens said the reforms are “both a clarification and an emphasis to the courts that they can’t continue to apply obsolete case law, they have to apply the text of the rule,” requiring judges to perform a gatekeeping function in evaluating witnesses for admissibility at trial.
