Federal Judge Decertifies FLSA Managers’ National OT Suit, Bloomberg Reports
Bloomberg Law News covered a federal judge’s decision to decertify a Fair Labor Standards Act (FLSA) collective of more than 1260 convenience store managers who claimed they were misclassified as exempt from overtime pay.
The U.S. District Court for the District of Massachusetts granted Shook’s motion to decertify the FLSA collective. The court wrote, “The employees’ work environments varied significantly depending on Speedway’s locations they worked at, making it impossible to determine if they were misclassified without delving into their individual circumstances.”
