Nissan Cleared in Rusty Floorboards Class Action
On February 1, 2016, Shook, Hardy & Bacon L.L.P. won dismissal of a purported nationwide class action against Nissan North America Inc. The suit, filed by 18 named plaintiffs from nearly as many states, claimed Nissan concealed the floorboards in certain vehicles were more prone to rust than normal.
Judge John Robert Blakely, U.S. District Court, Northern District of Illinois, ruled the Court did not have jurisdiction over the out-of-state plaintiffs. He dismissed all of the allegations of the Illinois Plaintiff for failing to state a claim for relief.
