Martucci, McMurray & Simsheuser: Employers Should Anticipate Pay Transparency
Pay transparency is coming and employers are well-advised to take heed, according to a recent law journal article written by Shook Partner Bill Martucci, Associate Luci McMurray and 2022 Summer Associate Jayke Simsheuser.
The three co-authored an article in the Fall 2022 issue of Labor Law Journal titled “Pay Transparency: The Trend All Employers Should be Anticipating,” in which they discuss what pay transparency is, legislative trends at the state and local levels, and how pay transparency fits into Environmental, Social and Governance (ESG) ratings.
In the article, they also advise employers that implementing pay transparency can help them achieve their goals of retaining top employees and recruiting quality talent.
“The more transparent employers are with their employees regarding compensation, the more informed employees will be when it comes to identifying and comparing competitive rates,” they write. “As a result, employees will not—or at least not as frequently—be leaving jobs based on an erroneous belief that they are being underpaid. In other words, employers with pay transparency policies are more likely to retain their employees, of course, so long as they are paying their employees at a competitive rate.”
