Woodbury and Hobbs Discuss Use of Litigation Guidelines in Light of Eleventh Circuit Ruling for Law360
Shook, Hardy & Bacon attorneys Marie Woodbury and Micah Hobbs have authored an October 7, 2014, analysis for Law360 about the Eleventh Circuit Court of Appeals’ recent opinion in Adams v. Laboratory Corp. of America, which discusses the limitations and considerations affecting the use of medical guidelines in litigation. “The problem identified by the Eleventh Circuit is that some of these guidelines, in particular those raised in the Adams case, purport to describe legal standards governing the admissibility of evidence rather than recommendations for patient treatment,” the authors note. “As recognized by the Eleventh Circuit, this runs afoul of the role of the courts and the jury.”
