Nissan Cleared in Rusty Floorboards Putative Class Action

Shook attorneys obtained the dismissal of a proposed class action alleging that Nissan Altima floorboards could not withstand normal exposure to the elements.
The complaint asserted state law claims from more than a dozen states, but the court found that the claims could not support personal jurisdiction for out-of-state plaintiffs. Further, the plaintiffs failed to state a valid claim rising to the level of particularity required for an assertion of fraud, the court found. Accordingly, the court dismissed the complaint in its entirety.
