Patent Ruled Invalid, Innovation Associates Prevails Against Rival ScriptPro
Kansas U.S. District Judge Carlos Murguia ruled on Monday, March 30 that ScriptPro LLC’s patent claims for its prescription-filling robotics were too broad, resulting in summary judgment for industry rival Innovation Associates Inc.
Monday’s summary judgment marks the second time that ScriptPro’s case against Innovation Associates has been tossed in district court. Both judgments focused on the lack of adequate written description.
Shook represented Innovation Associates; Intellectual Property Technology and Litigation Chair Trent Webb led the team; other Shook team members include Partners Angel Mitchell and Christine Guastello, and Associates Brittany Boswell and Jake Cranston.
